On September 28, 2021, the Presidents Co-op & Condo Council along with a consortium of leading Co-op and Real Estate advocacy groups submitted a joint letter to New York State Governor Kathy Hochul urging her to sign the Co-op Carve-Out to the Tenant’s Protection Act. This legislation passed both the State Senate and State Assembly in June 2021 and is awaiting the Governor’s signature. The intent of this letter was to try to push this matter over the finish line so that Co-ops can go about their business with clarity as to the various issues in the Carve-Out Bill, including late fees; legal fees; escrow deposits, and the jurisdiction of the Landlord-Tenant Court over Co-op non-payment cases.
